Terms of Service

1. Acceptance of Terms

By accessing or using Primaporn AI ("the Service"), operated by Tozradar ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. We reserve the right to update these Terms at any time. Continued use after changes constitutes acceptance.

2. Eligibility

You must be at least 18 years of age to use this Service. By creating an account, you represent and warrant that you are 18 or older and have full legal capacity to enter into these Terms. We use age verification measures and reserve the right to terminate accounts where age requirements are not met.

3. Account Registration

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete registration information.
• Maintain the security of your password and account credentials.
• Accept responsibility for all activities under your account.
• Notify us immediately of any unauthorized access.

We reserve the right to refuse service, terminate accounts, or remove content at our sole discretion.

4. Service Description

Primaporn AI provides AI-powered content creation tools including, but not limited to:

• AI image generation and enhancement
• Face swapping and transformation tools
• AI companion (AI Girlfriend) chat experiences
• Voice cloning and audio generation
• Script writing and creative assistance
• Encrypted content storage (Vault)
• Community marketplace for presets and models

The Service may include content that is explicitly adult in nature (NSFW). By using the Service, you acknowledge and consent to encountering such content.

5. Acceptable Use — Prohibited Activities

You agree NOT to use the Service to:

• Create content involving minors: Any content depicting, suggesting, or involving persons under 18 is strictly prohibited. Our AI systems include automatic minor detection that will immediately block such content. Violations will result in immediate account termination and reporting to law enforcement.
• Create non-consensual content: You may not use the Service to create deepfakes or manipulated media of real persons without their explicit, verifiable consent. This includes celebrities, public figures, and private individuals.
• Harass, threaten, or defame: Using generated content to harass, intimidate, blackmail, or defame any person is strictly prohibited.
• Distribute as real: Presenting AI-generated content as authentic/real media with intent to deceive is prohibited.
• Violate any law: Using the Service for any activity that violates local, state, national, or international law.
• Infringe intellectual property: Creating content that infringes upon trademarks, copyrights, or other IP rights.
• Distribute malware: Uploading viruses, malicious code, or using the Service for cyberattacks.
• Circumvent safety systems: Attempting to bypass age verification, minor detection, consent verification, or other safety features.

6. Consent Verification System

Primaporn AI implements a Consent Verification System to protect individuals:

• Self-consent: Users may register their own likeness (face) for use in AI generation.
• Authorized consent: Third-party subjects may authorize specific users to use their likeness through our verification process.
• Face-Locking: Registered likenesses are "locked" and cannot be used by unauthorized users.
• Likeness Protection Vault: Creators can register their face to prevent unauthorized deepfaking.

Using the likeness of any individual without proper consent registration constitutes a violation of these Terms.

7. Content Ownership & Licensing

Your Content: You retain ownership of content you upload to the Service (input images, prompts, etc.).

Generated Content: AI-generated outputs are owned by you, subject to these Terms. You are responsible for ensuring your use of generated content complies with all applicable laws.

License to Us: By uploading content, you grant Primaporn AI a limited, non-exclusive license to process and store your content solely for the purpose of providing the Service.

Community Content: Content shared in the Community Marketplace is subject to the licensing terms selected by the creator.

8. AI-Generated Content Disclaimer

All content produced by the Service is AI-generated and fictional. It does not represent real events, real persons, or real activities. Primaporn AI does not endorse, verify, or authenticate any content created using our tools. Users are solely responsible for how they use and distribute generated content.

9. Payment & Subscriptions

• Billing: Subscription fees are billed monthly in advance through Stripe. One-time credit purchases are charged immediately.
• Cancellation: You may cancel your subscription at any time. Access continues until the end of the current billing period.
• Refunds: Subscription fees are generally non-refundable. Unused credit packs are non-refundable. Exceptions may be made at our discretion.
• Price Changes: We may change pricing with 30 days' notice. Existing subscriptions are honored until their next renewal.
• Credits: Subscription credits reset monthly. One-time credit pack credits do not expire.

10. Privacy & Data Protection

Your privacy is important to us. Please review our Privacy Policy for detailed information on how we collect, use, and protect your data. Key points:

• Vault files are encrypted end-to-end using zero-knowledge encryption.
• We do not sell your personal data to third parties.
• Uploaded content is processed solely to provide the Service.
• You may request deletion of your account and all associated data at any time.

11. AI Watermarking

All content generated through the Service may include invisible digital watermarks (SynthID-style) identifying it as AI-generated. This is a safety feature designed to prevent misuse and maintain transparency. Premium users may have watermark-free exports, but content will still carry invisible AI provenance metadata.

12. Intellectual Property

The Service, including its design, software, algorithms, and branding, is owned by Tozradar and protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service without written permission.

13. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

14. Limitation of Liability

IN NO EVENT SHALL TOZRADAR, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

15. Indemnification

You agree to indemnify, defend, and hold harmless Tozradar and its affiliates from and against any claims, damages, losses, liabilities, costs, and expenses arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any rights of a third party; or (d) content you create using the Service.

16. Termination

We may terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion. Upon termination, your right to use the Service ceases immediately.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Norway, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Norway.

18. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
